Few things worry operators more than losing their Transport Manager. Whether through resignation, retirement, illness, or dismissal, the immediate concern is usually the same: Can we continue operating?

We recently assisted an operator whose Transport Manager resigned with little notice. The business had vehicles on the road, customers to serve, and no immediate replacement. Their biggest concern was whether they would lose their Operator Licence overnight.

Fortunately, the Traffic Commissioner recognises that these situations happen. Operators may be granted a Period of Grace to allow time to find a replacement Transport Manager.

A Period of Grace is not automatic. Operators must apply to the Office of the Traffic Commissioner and demonstrate that:

  1. They previously had suitable Transport Management arrangements in place
  2. They are actively seeking a replacement
  3. Compliance standards will continue to be maintained during the interim period

In many cases, a Period of Grace can be granted for up to six months, although each case is considered on its own merits.

While this provides breathing space, operators must remember that all Operator Licence obligations remain in place. Vehicles still need maintaining, drivers' hours still need monitoring, and compliance systems still need oversight.

Best practice includes:

  • Informing the Traffic Commissioner as soon as the Transport Manager leaves
  • Applying for a Period of Grace promptly
  • Documenting who is overseeing compliance activities during the transition
  • Keeping records of recruitment efforts and replacement interviews
  • Seeking support from an experienced external Transport Manager or compliance consultant where necessary

One of the biggest mistakes operators make is assuming they have plenty of time. Delays in notifying the Traffic Commissioner can raise questions about compliance management and may make obtaining a Period of Grace more difficult.
